When will pepper spray no longer be subject to gun law?
Pepper sprays that serve as “animal repellent sprays” are not subject to the Weapons Act because, by their nature, they are not intended to eliminate or reduce the ability of people to attack or defend themselves, but only to eliminate or reduce that of animals. They are therefore not considered irritant sprayers.
However, the animal repellent sprays are not considered weapons within the meaning of the WaffG if the manufacturer clearly produces and sells them as such. In the case of animal repellent sprays, the property of being used as a repellent spray against animals must be clear.
Unlike pepper sprays, there is no official approval for animal repellent spray. The animal repellent sprays can be purchased, owned and used by anyone.

At what age can pepper spray be used?
The pepper spray is a tested irritant spray device according to the Weapons Act and can already be used by young people in accordance with Section 3 Paragraph 2 of the Weapons Act .
According to Section 1 Paragraph 1 No. 2 of the Youth Protection Act, a young person is a person who is 14 but not yet 18 years old.
This means that people who have reached the age of 14 are allowed to have pepper spray.

In which situations can I use pepper spray?
Pepper spray is approved for animal defense in Germany. If a dangerous attack occurs, aim the pepper spray directly at the animal's eyes and snout to specifically ward off the attack.
The use of pepper spray against people is punishable as dangerous bodily harm.
However, criminal liability does not apply if there is a justification such as self-defense or emergency aid. In such cases, the use of pepper spray is justified by self-defense according to Section 32 of the Criminal Code, a state of emergency according to Section 34 of the Criminal Code or excused according to Section 35 of the Criminal Code.
What to do if you are hit by a defensive spray?
If in eyes: Rinse cautiously with water for several minutes. Remove contact lenses, if possible. Continue rinsing.
In case of contact with skin: Wash with plenty of water and soap. Do not apply creams or ointments. Staying in fresh air is recommended. If necessary, consult a doctor.
